Gift-A-Subscription Purchase and Redemption Terms

These Gift-a-Subscription Purchase and Redemption Terms (the “Gift Subscription Terms”) govern the purchase and redemption of an IPSY Gift-a-Subscription (“Subscription Gift”). They are in addition to and incorporate by reference our Terms of Use and Privacy Notice for all activities on IPSY.com (the “Site”).

PLEASE REVIEW THESE GIFT SUBSCRIPTION TERMS CAREFULLY PRIOR TO PURCHASING OR REDEEMING A SUBSCRIPTION GIFT FROM PERSONALIZED BEAUTY DISCOVERY, INC. (“IPSY,” “WE,” OR “US”). BY ENGAGING IN THE PURCHASE OR REDEMPTION OF A SUBSCRIPTION GIFT, YOU CONSENT TO BE BOUND BY THIS AGREEMENT AND ALL POLICIES INCLUDED HEREIN.

If you do not agree with any of these Gift Subscription Terms, please refrain from purchasing or redeeming a Subscription Gift.

1. SUBSCRIPTION GIFT ELIGIBILITY:

Subscription Gifts are valid for purchase and redemption by U.S. residents only and must be used exclusively on the Site.

2. SUBSCRIPTION GIFT PURCHASE:

Subscription Gifts are valid for a 3, 6 or 12-month IPSY Original or IPSY Extra subscription and are valid for shipments to U.S. addresses only. Your chosen payment method will be charged for the purchase amount. No additional fees are applied to the purchaser or recipient for the sale of a Subscription Gift.

An IPSY membership is not required to buy a Subscription Gift, though it is necessary for redemption. If purchased for another person, the recipient will be sent an email notification at the address provided during checkout.

3. SUBSCRIPTION GIFT REDEMPTION:

Redemption requires the recipient to be or become an IPSY Member. Subscription Gifts are valid for a 3, 6 or 12-month IPSY Original or IPSY Extra subscription and are valid for shipments to U.S. addresses only. Redemption eligibility remains subject to change at IPSY’s sole discretion.

Subscription Gifts are considered consumed upon redemption by the recipient. Shipments of the Subscription Gift will begin soon after redemption. Subscription Gifts will be shipped in consecutive months until the subscription ends. Subscription Gift value includes taxes and shipping fees. 

Existing IPSY Members: Members already paying for and receiving monthly shipments will receive their Subscription Gift shipments in place of the paid shipments. The Member’s paid monthly shipments will automatically resume the month following the end of the Gift shipments. 

If the Member’s monthly shipments were on pause at the time the Subscription Gift is redeemed, receipt of the Subscription Gift will remain on pause until the pause ends. If the Member was receiving every-other-month shipments prior to redemption of the Subscription Gift, the Subscription Gift will be shipped every-other month. Subscription Gift shipments may be managed in the Your Memberships page of the Member’s account at ipsy.com.

For existing Members with annual shipments, the Member will begin receiving the Subscription Gift after the annual shipments have completed.

4. LIMITATION OF LIABILITY:

IPSY AND ITS AFFILIATES PROVIDE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING SUBSCRIPTION GIFTS, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF A SUBSCRIPTION GIFT IS UN-REDEEMABLE OR GOES UNDELIVERED FOR REASONS OTHER THAN FULL REDEMPTION, OUR LIABILITY IS LIMITED TO REISSUANCE OF THE SUBSCRIPTION GIFT. SOME STATE LAWS MAY GRANT YOU ADDITIONAL RIGHTS OR PREVENT CERTAIN DISCLAIMERS OR LIMITATIONS FROM APPLYING TO YOU.

5. LIMITATIONS ON USE:

Subscription Gifts have no monetary value, cannot be returned for cash, are non-refundable, and are non-transferrable once redeemed. Subscription Gifts may not be combined with any other coupons, discounts or promotions. To the extent permitted by law, they cannot be reloaded, resold, or transferred for value. 

IPSY reserves the right to change or end the Gift-a-Subscription program at any time with or without notice.

Subscription Gifts are for personal use only and may not be utilized for commercial purposes, marketing, or promotional activities. Use of Subscription Gifts in a way that implies IPSY endorsement or affiliation without authorization is strictly prohibited.

6. FORFEITURE 

If a Subscription Gift recipient cancels her membership before the Subscription Gift is fully redeemed, the remaining shipments will be forfeited.

7. DELIVERY OF SUBSCRIPTION GIFTS:

We are not liable for Subscription Gifts that go undelivered due to an incorrect recipient email address. Please verify the address and contact IPSY CARE at help.ipsy.com if you suspect a delivery issue.

8. RISK OF LOSS:

Ownership and risk of loss pass to the purchaser upon electronic transmission. IPSY is not responsible for lost, stolen, or unauthorized use of Subscription Gifts. IN THE EVENT OF NON-FUNCTIONALITY OR UNDELIVERABILITY, YOUR EXCLUSIVE REMEDY IS A ONE-TIME RE-ISSUANCE OF THE SUBSCRIPTION GIFT TO THE RECIPIENT’S EMAIL ADDRESS. Proof of purchase is required for replacement. If a Subscription Gift is not received or is sent to the wrong email address, immediately contact our Care team at help.ipsy.com.

9. GENERAL TERMS:

The General Terms  and Legal Disputes sections in our Terms of Use are incorporated herein.

We may require identity verification or additional payment details before applying a Subscription Gift to an account.

If any part of these Gift Subscription Terms is found unenforceable, that part will be severed, and the remaining terms will stay in effect.

10. MODIFICATIONS TO GIFT SUBSCRIPTION TERMS:

IPSY reserves the right to modify these Gift Subscription Terms at any time, with or without notice, in accordance with applicable laws. Updated terms will be posted on the Site and will supersede all prior versions.
