The IPSY Rewards Program (the “Program”) is a benefits program brought to you by Personalized Beauty Discovery, Inc. (“IPSY,” “us” or “we”). This Program is designed to allow IPSY Members like you get the rewards you deserve just for being a loyal member with an active subscription. Participation in the Program is subject to these IPSY Rewards Terms & Conditions (“Program Terms”), as well as IPSY’s Terms of Use and Privacy Notice, which are incorporated herein (collectively, the “Agreement” and collectively with the Program Terms, the “Terms and Conditions”). These Program Terms constitute a legal agreement between you and IPSY. In the event of any conflict or inconsistency between these Program Terms and the Agreement in connection with the Program, these Program Terms shall prevail. All capitalized terms not defined in these Program Terms shall have the meanings given in the Agreement.
By participating in this Program, you are agreeing to these Program Terms and any Program Policies posted on the IPSY Services. If you do not agree to these Program Terms, you may not participate in the Program.
The Program is open to Ipsters with an active and valid Membership who are of Legal age, subject to their compliance with the Terms and Conditions (“Program Members”). To be eligible for the Program, you must be an individual residing in the United States, U.S. Territories, or Canada, (except for residents of the Province of Quebec) be at least the age of majority in your state of residence and maintain an IPSY Membership in good standing. Methods of participating in the Program may change from time to time.
Program Rewards are personal to you and cannot be combined with other offers or accounts and cannot be transferred.
A Program Member can earn rewards and other benefits (“Rewards”) by taking actions within certain time periods as specified in these Terms or on the IPSY Services (a “Qualifying Action”). These actions may include using the IPSY Services to make a certain number or dollar amount of purchases within a certain time period, keeping a Membership active for a specific period of time, and completing various activities. Additional terms and opportunities to earn Rewards may apply.
If you take a Qualifying Action that requires a transaction on the IPSY Services, Rewards will be earned at the time we process the transaction, unless otherwise specified. If you perform a Qualifying Action outside of our Services (e.g., at a live event), Rewards will be earned as specified in the applicable instructions. There may be some delay between your completion of a Qualifying Action and the issuance of the Reward for that action in your account.
Rewards may be revoked if a transaction for which a Reward was earned is refunded or cancelled (in whole or in part). Rewards may also be revoked where we believe in our sole discretion that Rewards were earned through or in connection with any fraud, abuse of the platform, or violation of these Terms and Conditions.
Unless otherwise specified, Program Members with multiple Memberships (e.g., subscriptions to both IPSY Original and IPSY Extra) are only eligible for one Reward per Qualifying Action. Rewards earned in different accounts owned by the same Member cannot be combined.
Rewards have no cash value, may not be redeemed for cash, and are non-transferrable.
Social Media Posts or Other Public Statements. Where a Qualifying Action involves posting about IPSY or any IPSY-related services, you must clearly and conspicuously disclose your connection with IPSY (e.g., “I earn rewards when I post about IPSY,” “#ad,” “#sponsored”) and comply with applicable law and platform rules. Your statements must be truthful and not misleading. If we learn that you have violated this requirement, you will be immediately suspended from the Program and you will lose all rights to any Rewards whether based on prior or future activity.
a. Status
Taking certain Qualifying Actions can also earn you a reward level status (“Status”) that makes you eligible for additional and/or higher Rewards as you complete Qualifying Actions. Your Status is determined based on the total cumulative amount you spend on the IPSY Services (including the price of your Membership(s), add-ons orders, IPSY Shop purchases, gift Memberships, and other offerings made available for purchase from time to time), excluding taxes and shipping fees, during a rolling 12-month period that begins on the date you first participate in the Program by activating you Membership (“Yearly Spend”). There are four Status tiers that you may achieve based on your Yearly Spend:
Explorer = $1 to $75
Muse = $75.01 to $200
Trendsetter = $200.01 to $500
Icon = $500.01+
To maintain your current Status for the next 12-month period, your Yearly Spend must meet the applicable threshold for that Status. If at any time your Yearly Spend falls below the applicable threshold, you may be moved to a lower Status or lose your Status. Status and spending thresholds will be specified on the IPSY Services.
You may move to a higher Status at any time during the 12-month period if your Yearly Spend meets the applicable spending threshold for that higher Status. You will be eligible for the Rewards associated with that higher Status on the date you qualify, and a new 12-month period will begin. That new period will be used to determine whether you retain that Status. Your prior spend from the earlier 12-month period will still count toward determining whether you qualify for additional Status upgrades.
Program Members must remain active with IPSY in order to maintain their Status. If no spending activity is detected on a Program Member’s account for six consecutive months, the Program Member will lose her Status and any benefits associated with that Status.
b. Streaks
If you have an active Membership, you may also be eligible for Rewards if you receive at least one IPSY Box each month for a certain number of consecutive months (a “Streak”). If you have multiple Memberships under a single account, you will only receive credit toward one Streak. For Program Members with multiple Memberships, at least one Membership must ship in consecutive months to count towards the Streak. Pausing a Membership, selecting a shipment frequency other than monthly, or a payment failure or any other action or inaction that results in a shipment not being completed in a month will void a Streak.
Once you complete a Streak, you may have the opportunity to complete additional Streaks that unlock additional Rewards. Rewards may differ based on the Streak you complete and your current Status. The higher your Status, the higher the Reward. Streaks are based on consecutive monthly shipments of your IPSY Box for the following periods:
Streak One = 4 months
Streak Two = 8 months
Streak Three = 12 months
Streak Four = 16 months
Streak Five = 20 months
Streak Rewards may include coupons to use towards IPSY Shop purchases, Add-ons purchases, subscription discounts, and more. Different coupons may have different terms for redemption and expiration. Some coupons such as those for Add-ons require an active Membership in order to redeem. Refer to each coupon you earn for details. Once coupons are earned, they will be valid for one-time use and for a limited time as follows:
IPSY Shop = 30 days
Add-ons = 45 days
Subscription = 45 days
Streak Rewards may not be combined with other offers or coupons. Expired, unused Streak Rewards will not be reissued. Streak Rewards have no monetary value.
Rewards may be subject to redemption requirements and other limitations, which will be specified on the IPSY Services. For example, certain Rewards may require you to claim and/or redeem them within a specific time period or may require an active Membership for redemption.
We reserve the right to modify any Status, Streak, Rewards, or redemption conditions at any time, in our reasonable discretion.
You can view your current Status, Streak, and Rewards in your Loyalty Dashboard located in your account. If you think your Status, Streak, or list of Rewards is incorrect, you must report your issue before they expire (if applicable) by contacting the IPSY Care Team here.
If a Program Member cancels all of their Memberships and does not take a Qualifying Action within a specified period of time, they may lose their Status and any unredeemed Rewards.
Rewards are subject to expiration unless prohibited by applicable law. For example, Rewards may expire if you do not earn or redeem any Rewards for a year after you last earned or redeemed a Reward. Expiration dates will be specified on the IPSY Services.
IPSY may suspend, revoke, or terminate your participation in the Program or refuse to provide you with a Reward or Status in its reasonable discretion, for any reason. If your Program participation is terminated, all your Rewards will be forfeited immediately upon termination. If your Program participation is terminated due to fraudulent activity, noncompliance with these Program Terms, or violations of the Agreement, in addition to forfeiting all your Rewards immediately, you may be prohibited from participating in or rejoining the Program and your IPSY account may be terminated.
We reserve the right, in our reasonable discretion, for any reason, to change or terminate the Program, or any part, rules, or features thereof, at any time without notice, without liability, and without further obligations to Program Members, including but not limited to modifications which: a) result in the suspension or cancellation of any Program Member’s participation (and/or seize any Rewards associated with such account) if that Program Member has violated these Program Terms, in our sole discretion; or b) change, modify, delete (in whole or in part), supplement and/or cancel any Program Terms, regulations, benefits, or policies in connection with the Program, including but not limited to Rewards, redemption requirements, eligibility qualifications, conditions of participation, rules for earning, redeeming, retaining or forfeiting Rewards, rules for the use of Rewards or benefits in connection with the Program, Reward expiration rules, etc. To the extent required by applicable law, we will provide notice of material changes to these Program Terms. Any and all changes and/or amendments to the Program and these Program Terms will become binding upon all Program Members immediately. Please review these Program Terms periodically to ensure you are aware of any changes and are familiar with the most current version. Following any change to these Program Terms, your continued use of the Program constitutes your acceptance of the revised Program Terms.
No Rewards will be earned after the effective date of termination.
Our rights and obligations under the Program may be assigned or transferred by us to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.
All interpretations of these Program Terms will be at our reasonable discretion and our decisions will be final.
We reserve the right to any remedy, including refusal to issue or honor Rewards, in the event of suspected fraud. We will have the right to close IPSY Services accounts if fraudulently obtained Rewards are redeemed.
This Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions or errors of the Program or its features. We are not responsible for unauthorized use of Rewards. We may from time-to-time request information from you to verify your identity, rights to Rewards, or ownership of an account before we allow use of your Rewards. We may delay your access to Rewards until you comply with this information request. The Program and all the information accessible through it are provided for information purposes only on an "as is" and "as available" basis. We, our information providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO REWARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Any dispute or claim relating in any way to the Program will be resolved in accordance with Sections 9 and 10 of IPSY’s Terms of Use.
